Department of State announces disciplinary actions against 115 licensed professionals in PA

HARRISBURG -- The Department of State took disciplinary actions against 115 licensed or commissioned professionals and organizations during the month of December, Secretary of the Commonwealth Carol Aichele announced today.

A comprehensive list of sanctions imposed by the Bureau of Professional and Occupational Affairs is available online HERE

Each entry includes the name of the respondent, address, sanction imposed, a brief description of the basis for the disciplinary or corrective measure and the effective date.

Anyone who suspects unlicensed activity by an individual or facility, or who has been a victim of unethical treatment, can file a complaint either online or through the bureau’s hotline at 1-800-822-2113.

The bureau’s 29 boards and commissions license and oversee more than 900,000 active professionals and businesses, including a range of occupations in health and business-related fields.

Violations of the law or state regulations may result in disciplinary actions of civil penalties and the suspension or revocation of a license.

Locally those who were disciplined are:

PA Board of Certified Real Estate Appraisers, York County, Brian E. Raines, certificate no. RL139323, of York, York County, was ordered to pay a civil penalty of $2,000 and costs of investigation of $1,000 and ordered to successfully complete at least 29 total hours of remedial education because he failed to complete an appraisal assignment within the requirements of the USPAP. PA Board of Chiropractic, York County Stephen S. Grim, license no. DC001732L, of Manchester, York County, was indefinitely suspended due to being unable to practice chiropractic with reasonable skill and safety to patients as a result of any mental or physical condition. (11/21/13)

PA Board of Cosmetology, York County, Quyen Hoang Vu, license no. CL186101, of York, York County, was suspended for failing to pay a previously imposed civil penalty. (10/10/13)

PA Board of Funeral Directors, Lancaster County, Benjamin M. Siar, Jr., license nos. FD015207 and FS015106, of Conestoga, Lancaster County, was revoked effective February 1, 2013, because he engaged in gross incompetency, negligence or misconduct in the carrying on of the profession, failed to provide full and factual representation concerning aspects of the services rendered or the funeral furnishings provided, engaged in unprofessional conduct by retaining funds intended to pay for funeral goods and services in excess of the value of funeral goods and services actually provided. PA Board of Funeral Directors, Lancaster County, Gundel Funeral Home, license nos. FR013809 and FB014516, of Conestoga, Lancaster County, was revoked effective February 1, 2013, because they engaged in gross incompetency, negligence or misconduct in the carrying on of the profession, failed to provide full and factual representation concerning aspects of the services rendered or the funeral furnishings provided, engaged in unprofessional conduct by retaining funds intended to pay for funeral goods and services in excess of the value of funeral goods and services actually provided. PA Board of Landscape Architects, Cumberland County, Craig W. Bachik, license no. LA000850E, of Camp Hill, Cumberland County, was placed on probation for a period of two years and assessed a civil penalty in the amount of $1,000 for conviction of a felony crime. (08/12/13)

PA Board of Medicine, Lancaster County, John Matthew Yelcick, license no. MD058018L, of Lititz, Lancaster County, voluntarily surrendered his license to practice medicine while his criminal case is pending in Lancaster County because his continued practice of medicine and surgery makes him an immediate and clear danger to public health and safety. PA Board of Nursing, Dauphin County, Jadan June Hampton, license no. PN271777, of Harrisburg, Dauphin County, was indefinitely suspended for no less than three (3) years, stayed immediately in favor of no less than three (3) years of probation, subject to terms and conditions as set forth in the agreement, because she is addicted to alcohol or hallucinogenic or narcotic drugs or other drugs which tend to impair judgment or coordination or had become mentally incompetent and has been convicted or has plead guilty to a crime of moral turpitude in a court of this Commonwealth. PA Board of Nursing, Lancaster County, Lynn Rill Stoltzfus, license no. PN097537L, of Willow Street, Lancaster County, was ordered to pay a civil penalty of $1,000 and a public reprimand was placed on her permanent disciplinary record, because she practiced practical nursing on an expired license. PA Board of Nursing, Lancaster County, Matthew Steven Bender, license no. RN609291, of Elizabethtown, Lancaster County, had his license to practice professional nursing suspended retroactive to February 27, 2012, such suspension immediately stayed in favor of probation retroactive to February 27, 2012, subject to certain terms and conditions, because he is unable to practice professional nursing with reasonable skill and safety by reason of mental or physical illness or condition or dependence upon alcohol, hallucinogenic or narcotic drugs or other drugs which tend to impair judgment or coordination. RN322597L, of Lebanon, Lebanon County, was suspended, such suspension immediately stayed in favor of probation, subject to certain terms and conditions, because she is unable to practice professional nursing with reasonable skill and safety by reason of mental or physical illness or condition or dependence upon alcohol, hallucinogenic or narcotic drugs or other drugs which tend to impair judgment or coordination. PA Board of Nursing, York County, Amy Nadine Coppersmith, license no. PN251013L, of York, York County, was suspended, such suspension immediately stayed in favor of probation, subject to certain terms and conditions, to include, but not be limited to, the attendance and successful completion of at least 20 hours of remedial education relating to the caring of a child with a trachea tube and the topics of nursing law and ethics, because she failed to respect and consider, while providing nursing care, the individual's right to freedom from psychological and physical abuse, and was guilty of unprofessional conduct or such conduct as to require a suspension or revocation in the public interest. PA Board of Pharmacy, Dauphin County, Derek G. Paskaitis, license no. RP042477L, of Harrisburg, Dauphin County, was indefinitely suspended for no less than three years, such suspension to be immediately stayed in favor of no less than three years of probation under the Disciplinary Monitoring Unit, because he pleaded guilty to an offense in connection with the practice of pharmacy and/or an offense involving moral turpitude. PA Board of Psychology, Lancaster CountyHarold V. Kulman, license no. PS001799L, of Marietta, Lancaster County, was suspended for a period of 15 days and ordered to complete 15 contact hours of board-approved continuing education necessary to meet the requirements for the December 1, 2009 to November 30, 2011 biennial reporting period within six months from the effective date of the order because he failed to complete 30 contact hours of continuing education in acceptable courses, programs or activities for the biennial reporting period of December 1, 2009 to November 30, 2011.
