Reported by: Michael Gorsegner

The Lancaster County District Attorney has determined that a Lititz Police Officer acted within the law, when he shot and killed a man in December.

District Attorney Craig Stedman released the findings of the investigation on Tuesday. Officer Joel Hartz shot David Gilbiberti six times during a fight at his Lititz home on December 21st.

The report showed Giliberti fought with officer Hartz for several minutes before coming at him with a kitchen knife.

Hartz tased the victim three times with no success.

“The loss of life in this case was regrettable and tragic but it was unavoidable and completely justified," said Lancaster County District Attorney Craig Stedman.

Officer Hartz is a 24-year veteran of the Lititz Police force and has been on administrative leave and workman's comp since the shooting.
