Susquehanna Twp files motion to dismiss claims in civil suit against administrators in teacher sex case

HARRISBURG -- A motion filed Monday in the Middle District of Pennsylvania Court by Boyle Litigation seeks to dismiss many of the claims against Susquehanna Township School District, Superintendent Susan Kegerise, the schools attorney and other administration members from the Shawn Sharkey lawsuit. 

Sharkey was charged in September by the Dauphin County district attorney for allegedly having sex with a student.

This civil case was filed by the victim's mother against Sharkey and the school district for negligence.

This would leave Shawn Sharkey as the lone defendant in the civil lawsuit.

The motion to dismiss argues, among other things, that Kegerise and the Susquehanna Township School District administration were unaware of the pattern of incidents by Sharkey.

It also argues that they performed all necessary duties in checking in to Sharkeys background when hiring him. 

The filing says that the failure to report Sharkey's conduct, as alleged in the lawsuit, is not true because none of the administrators had reasonable cause to believe Sharkey was involved in a sexual relationship with the student.  Susquehanna Twp files motion to dismiss claims in civil suit against administrators in teacher sex case
