York County man accused of killing girlfriend's baby will stand trial

UPPER DARBY -- All charges stuck today against a York County man accused of killing his girlfriend's baby and then hiding the baby's body.

The mother of the baby talked frankly and calmly about the last night she saw her baby boy alive inside a courtroom in Delaware County.

Upper Darby Police Chief Michael Chitwood said the baby's mom was a perfect witness. She is now living outside the state.

"She said he (Rushdi) took the baby from her and she tried to get the baby back the night the baby disappeared because the baby was hysterical and the baby was afraid of him, because (of) the way he treated the baby," Chitwood said.

That testimony and more convinced the judge that all charges against Ummad Rushdi should be sent to trial as police continue to hunt for the baby who is presumed dead after a jail house confession made by Rushdi.

"He is not telling us where the baby is," Chitwood said.

Police believe Rushdi killed 7-month-old Hamza Ali at a family member's home in  Upper Darby and then traveled back towards his home in York County and somewhere along the way, police believe he buried the baby.

"He knows where he buried that baby, where he put that baby, and that is still a priority," the chief said.

Since Rushdi isn't talking, police are putting pressure now on his family members, today issuing a grand jury subpeona to his sister as she attended the court hearing today.

Police say it is important to get people to talk whether voluntarily or involuntarily. They say the mother of the baby calls the police station every day to find out if the baby has been found.

The district attorney in Delaware County must decide whether this will be a death penalty case. That decision could come at Rushdi's formal arraignment, which is set for Nov. 6.York County man accused of killing girlfriend's baby will stand trial
